Terms and Conditions


Welcome to SJ Languages. These terms and conditions are valid for all tuition services from 1st January 2024. I reserve the right to make changes to these terms and conditions from time to time and clients will be notified of these with as much notice as possible.


By booking a class, course, private tuition or event with Samantha Kelly trading as SJ Languages, you are entering into a contract which has the following conditions:


  1. Definitions

1.1 “Client” refers to the Client or individual who books courses or language tuition services with SJ Languages.


1.2 “Tuition” refers to the language tuition service provided by SJ Languages, including classes, courses, one-to-one tutoring lessons and workbooks.


1.3 “Tutor” refers to Samantha Kelly, the individual who delivers the tuition service, providing instruction and guidance to the Students.


1.4 “Lessons” refer to individual instructional lessons conducted as part of the tuition service, whether in a class, course, or one-to-one setting.


1.5 “Students” refer to the individuals receiving the language tuition support and instruction through our tuition services and courses.


1.6 “Fees” refer to the charges associated with the provision of our tuition services, courses, or products.


1.7 “SJ Languages” or “We/Us” refers to the language tuition company named SJ Languages, providing French and Spanish language tuition and educational services and resources to Clients and Students.



  1.  Group Class (including programmes, masterclasses and workshops)

2.1 Definition. 

Group Class refers to group tuition, with other students. As applicable, please refer to the relevant details for your Group Session on our website.This will also explain whether your sessions are online and how to access them, or where they will be held. 


2.2 Thinkific - Online group classes, programmes and memberships

SJ Languages uses the software programme Thinkific to book, manage and invoice all clients and students for online classes. Course material and links to online lessons can be accessed on the student platform using your personalised log-in you will receive upon purchase of a course.


2.3 Class Fees and Payment

Fees vary depending on the group class or programme you are purchasing from SJ Languages. Fees may be adjusted and shall become effective after having given the student 14 days written notice.


All prices that are advertised on our website and promotional literature are correct at the time of booking. SJ Languages reserves the right and discretion to change and amend our prices at any time. Please check the website for the latest offers before you purchase. Once a course is purchased, the cost will immediately be charged.


The Course fee is split across monthly payments with the first month paid at the time of booking to secure a place. Clients can also request to pay in full at the time of booking. 


Group classes and programmes will have set end dates. By registering you or your child for a class or programme, you agree to you or your child attending the course for the length of the class or programme. 


No refund or compensation will be made for non-attendance.


2.4 Cancellation of Lessons by Student

Fees are based upon the Student's undertaking to attend all lessons as stipulated in the class or programme schedule and no discount or refunds shall be given in respect of lessons not attended by the Student or withdrawing from a course.


If you or your child are unable to attend an individual group class, please inform your Tutor as soon as possible. You can catch up with the lesson content using the video replay which will be made available on the online learning platform and available for 4 weeks. If the class is in-person then your Tutor may be able to provide a summary of the content covered or a copy of any resources used. 


2.5 Withdrawal from Course by Client

If you wish to withdraw your child from a course that has already commenced, please notify Samantha Kelly via email at [email protected] and stop your payments. Your child is entitled to attend lessons until the end of the month following the last payment made. For clarity, if your last successful payment is on February 10, 2024, your child can attend lessons and access course materials until March 10, 2024. No refunds will be issued for resources or tuition fees.


If a client has booked and paid in full, no refund will be given as the full course has been booked, and the client can access replays and course materials until the course's conclusion.


For intensive courses, masterclasses, and workshops, fees will only be refunded if a cancellation notice is received by email before the course begins. Refund amounts are as follows: a full refund if the cancellation notice is received 28 days before the course commences, a 50% refund if received between 27 and 14 days before the course commences, and no refund if the cancellation note is received 13 days or less before the course starts. Please note that payments made for taster sessions are non-refundable.


2.6 Cancellation of Lessons and courses by Tutor

If Samantha Kelly has to cancel a group class, event or webinar at short notice for any reason, she will email all registered attendees at the first available opportunity and a notice will be posted on the SJ Languages Facebook page. 


An alternative session will be organised if possible (registered attendees will be notified via email). If this is not possible, Samantha Kelly will produce a recording of the event content within 72 hours of the session’s start time and email it to all those registered for the session. This recording may be shorter than a normal session due to the lack of student interaction.


Every effort is made to run the classes as advertised, but they may be cancelled, rescheduled, or postponed if the course fails to meet the minimum student number required. If the minimum number of students is not met and the group class is cancelled, then Samantha Kelly will contact you to discuss alternative service options. If a suitable alternative is not found, then a full refund will be given.


In the event of any unexpected event or any unforeseen circumstances that hinder, delay, or lead to cancellations of any session, Samantha Kelly will not be liable for any costs incurred or repay any monies received.  


This includes but is not limited to, severe weather, fire, flood, Covid-19 and other disease epidemics, strikes, acts of God, war or terrorist activity, government actions, war, and failure of 3rd parties such as venues to provide their services. 


2.7 Late Arrival

Fees are calculated according to the times stipulated in the schedule and no adjustment shall be made for time lost because of late arrival or start by the Student.

Any lost time because of the late arrival of the Tutor shall be compensated for by extending a lesson by mutual agreement and by such amount of time that was lost.

The Tutor will always give prior warning if they think that there is a possibility that they will arrive past the agreed time. 


  1. Terms and Conditions for SJ Languages Self Study Online Courses. 

3.1 Definition

Self-study Online courses are courses delivered via the Thinkific platform, available at the courses.sjlanguages.co.uk website. These courses can be made up of a range of learning materials including video tutorials, printables and quizzes.


3.2 Acceptance of Terms

By completing your registration for an Online Course and making a payment, you agree to the following Terms and Conditions:


3.3 Use of Course Materials

All course content, including text, videos, images, and any other materials provided through our online courses, are the intellectual property of Samantha Kelly or third parties used under permission granted to Samantha Kelly trading as SJ Languages. Use of materials is restricted to registered individuals for the online course or as approved by Samantha Kelly. Unauthorised distribution of materials will result in immediate revocation of access. Except as expressly stated herein, nothing in these Terms will be considered as a licence in or under such Intellectual Property Rights and you agree not to sell, licence, modify, copy, reproduce, transmit, adapt, unless authorised by Samantha Kelly.


3.4 Use of Third-Party Materials

In some instances, our courses may include materials obtained from third parties, and these materials are subject to the respective third-party terms and conditions. You agree to comply with any additional terms and conditions provided by such third parties.


3.5 Registration and Accounts

To access our online courses, you will be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.


3.6 User Conduct

You agree not to use our online courses for any unlawful or prohibited purpose. You may not interfere with the proper functioning of the courses, and you must not attempt to gain unauthorised access to any part of the courses.


3.7 Payments

Payment for our online courses is required before gaining access. We reserve the right to change our course fees at any time. 


3.8 Cancellations and Refunds

Our cancellation period is 14 days. Any purchase cancelled within 14 days of payment will be eligible for a refund unless you have started the course and/or accessed any downloadable content.


Once you begin the course, you are no longer eligible for a full refund, even if you ask for a refund within 14 days of payment.


Once a course has been redeemed, we cannot grant a refund.

Any refund will take up to 30 days to process.


3.9 Responsibility for Loss

Registrants are responsible for their actions during the course and indemnify SJ Languages from liability resulting from their actions or breach of terms.


3.10 Promotional Offers

Discounted offers are at SJ Languages' discretion, subject to change without notice. Customers are responsible for verifying coupon codes. SJ Languages is not liable for missed discounts due to incorrect code application.


3.11 General Disclaimer and Rights

SJ Languages is not responsible for the accuracy of reference materials or linked content. SJ Languages reserves the right to deny access to individuals not agreeing to these terms.


3.12 Course Management System Access

Unauthorised access or use of robots or devices to compromise security controls is prohibited. Reproduction or alteration of content without prior written permission is not allowed.


3.13 Termination of Access

We reserve the right to terminate or suspend your access to our online courses at our sole discretion, without notice, for conduct that we believe violates these terms or is harmful to other users of the courses, us, or third parties, or for any other reason.


3.14 Disclaimer of Warranties

Our online courses are provided on an "as-is" and "as available" basis. We make no warranties, either expressed or implied, regarding the content, accuracy, or reliability of our courses.


3.15 Limitation of Liability

To the fullest extent permitted by applicable law, SJ Languages shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.



  1. Private Class (One-to-One/Paired Tuition)

4.1 Definition

Refers to tuition where a tutor works with a Student in a one-to-one or one-to-two setting, either face-to-face or online.


4.2 Booking and Payment for ad-hoc and short term private lessons.

Pay as You Go lessons are booked via SJ Languages Calendly page. 30 minute and 1 hour sessions available. A booking link will be sent to you upon enquiry.


4.3 Booking and Payment for packages of lessons and long-term tuition.

Upon confirmation of availability for the desired date and times for tutoring, we will send you the link to our booking page to complete registration and payment.


Students have the option to pay in full at the time of booking or split the cost across monthly payments with the first month paid at the time of booking to secure a place.


SJ Languages uses the software programme Thinkific to book, manage and invoice all clients and students for tuition. 


Through this system, you will be able to find a record of your booked lessons and keep a history of your invoices and payment receipts. 


4.4 Cancellation of Lessons by Student

The cancellation period is 48 hours, given in writing by email to [email protected].  

All lessons are non refundable and no refunds for rescheduled or missed lessons will be made. 

If 48 hours' notice is given, the cancelled lesson will be credited to the following month/term/block of sessions or rescheduled to another time that is convenient for both you and the tutor. The session is charged as taken if less than 48 hours' notice is given. Lessons and tailored tutoring services take a long time to prepare and will often be organised in advance. If for any reason you need to reschedule an agreed lesson, the Tutor Samantha Kelly is happy to do so, subject to availability at a date/time that is mutually convenient to both tutor and student, when at least 24 hrs notice has been given as above.


Repeated Cancellations – Samantha Kelly reserves the right to withdraw tuition for repeated cancellations and/or no-shows.


In a possible situation where the student has an infectious illness (such that they would be expected to stay away from their place of education/work) or is unable to travel to the lesson venue. No face-to-face lesson will take place in that case, but an online lesson will be offered as a substitute. Samantha Kelly is under no obligation to provide an alternative lesson slot for any reason.


4.5 Termination policy: One-to-One Tuition will continue until a mutually agreed termination date, subject to 14 days' notice on either side. Both parties reserve the right to terminate lessons should they no longer be considered beneficial to the student. All sessions will still be delivered as arranged during the two-week notice period. This will allow us to wrap up any topics we are a part way through covering.


4.6 Cancellation of Lessons by Tutor for one-to-one/pair tutoring:

If Samantha Kelly chooses to cancel a tutoring session, then all monies paid for that session to Samantha Kelly will be refunded or can be credited to the following month. In this circumstance, Samantha Kelly will not be liable for any other expenses incurred by the client, including but not limited to travel costs, etc.


In the event of any unexpected event or any unforeseen circumstances that hinder, delay, or lead to cancellations of any session, Samantha Kelly will not be liable for any costs incurred or repay any monies received.

4.8 Student progress and parental involvement

It is the client's/parents/carer's responsibility to provide any additional information they feel is important to tuition (for example medical conditions/special education needs etc.) 


For students under the age of 18, parents/carers are welcome to join the tutoring session at the beginning or end of the lesson for feedback. I do not provide written progress reports.


  1. Online Sessions: 

All sessions are scheduled over Zoom. You can access the Zoom link via your student portal (if on-going tuition/class) or you will be emailed the details (Pay-as-You go sessions). 

Tuition is best with a larger screen, such as on a laptop. It can also work very well to have another device, such as a phone or iPad nearby for group activities (such as Blooket, Quizziz and Kahoot quizzes).

You will need a reliable internet connection which allows the student to have a continuous meeting with the Tutor which lasts at least 30 minutes or 1 hour depending on your lesson. Please contact [email protected] if there are any issues with this.


  1. Status of the Tutor

It is expressly understood that the Student retains the services of the Tutor as an independent contractor through SJ Languages and not as an employee. 

The Tutor shall be responsible for his/her insurance and for all statutory declarations and contributions with regard to income tax.


  1. Minors - Safeguarding:

Any student/s under the age of 18 requesting a tuition service must have parental or a legal guardian’s permission to do so. Parent/Guardian shall enter into this tutoring contract on behalf of the Student and shall accept and agree to all the terms and conditions contained herein on behalf of the Student.

Please ensure a safe and communal study area for both online and in-person sessions: this should NOT be a bedroom and doors should remain unlocked and ajar. It is expected that parents/guardians are at home during tuition. Sessions may be recorded but will not be shared with anyone other than the meeting participants.

For face-to-face tuition that takes place in an appropriate hired venue such as a community room, local hall or schoolroom, parents/guardians are welcome to attend the tutoring session. If a parent/guardian is not present, then the tutor will ensure that the student is comfortable to continue the session, if not, they can terminate the session.

  1. Behaviour/Student Expectations: 

Abusive or discriminatory behaviour towards the Tutor and/or other students will not be acceptable. The Tutor reserves the right to cancel any bookings for students whose behaviour is unacceptable, or where abusive language is used by either the client, parent or student. Although this is very unlikely, you will, of course, receive a refund for outstanding lessons if the Tutor needs to enforce this.


  1. Technical Issues: 

For online sessions, it is the student’s responsibility to provide a suitable internet connection and a device to use for tutoring. Your Tutor will try to accommodate minor technical issues wherever possible however Samantha Kelly is not responsible for any technical issues that may arise during the session due to the student’s internet or device. We would recommend doing regular checks that your device, connection and zoom are working and to log on at least 10 minutes prior to the start of the session to allow time for troubleshooting.


Disruption to the tutor's internet connection

If the Tutor’s internet connection is lost at any point during an online class, event or webinar session or immediately before, emails will be sent to all registered attendees at the first available opportunity and a notice will be posted on the SJ Languages Facebook page. The session will be restarted immediately or an alternative session will be organised if possible (registered attendees will be notified via email). If this is not possible, the Tutor will produce a recording within 72 hours of the event or webinars start time and email it to all those registered for the session. This recording may be shorter than a normal session due to the lack of student interaction. For private tuition, the lost session will be credited to the next month. 


  1. Bank Holidays

Should a class or tutoring service fall on a Bank holiday; it will be rescheduled - a course may be extended to recoup the Bank Holidays.


  1. Limitation of liability

While the Tutor will strive to provide the best possible service. The Tutor will endeavour to ensure that the student makes satisfactory progress. This cannot be guaranteed, and the Tutor cannot be held accountable for the academic success or otherwise of the student. Samantha Kelly trading as SJ Languages cannot guarantee a particular grade or result as there are many factors that contribute to a student's success in exams. The Tutor is not liable for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special, or exemplary damages arising from the use of this tutoring service provided by Samantha Kelly trading as SJ Languages or any errors or omissions in the contents of the learning materials. You, the client, specifically waive any and all claims arising out of the use of the tutoring service. 


  1.  Intellectual Property Rights

All courses, workbooks, worksheets, videos and other learning resources created by Samantha Kelly trading as SJ Languages remain the intellectual property of Samantha Kelly and are not to be duplicated, shared or posted online.


  1. Photography and recordings

The video/audio recording of sessions by students/attendees is strictly prohibited.


From time to time, Samantha Kelly takes photos of students' work and activities taking place. These may be published on our website and on social media. Your or your children’s faces are not shown in photos unless permission has been given by you or the parent/guardian. Any resources issued are given for the use of Samantha Kelly's (trading as SJ Languages) students only, and these resources must not, under any circumstances, be copied, reproduced or shared with anyone else (in whole or in part). 


  1. Gift vouchers

Gift vouchers may not be exchanged for cash and are non-refundable. Gift vouchers can be exchanged or put towards any tuition service, course or product offered by Samantha Kelly at SJ Languages, regardless of what the gift voucher was originally intended for. If the value of a 

lesson or course is less than the value of the gift voucher, any balance will remain as credit against your gift voucher, and you can redeem it against subsequent lessons or courses until the gift voucher expiry date. Gift vouchers are valid for 12 months from the date of purchase.


  1. Changes to Terms and Conditions

Samantha Kelly trading as SJ Languages reserves the right to change the Terms and Conditions at any time. Any changes to the terms and conditions of the tuition contract will become effective after having given the Student 7 days written notice.
